A federal judge in California is throwing out a trademark infringement lawsuit filed by Playboy Enterprises against the seller of Halloween costumes. The plaintiff claimed Los Angeles-based Fashion Nova sold outfits that spoofed its bunny costumes worn by female employees at the now-defunct Playboy Clubs. The company said in a lawsuit filed last year the defendant's version of the Playboy Bunny outfit is an "attempt to confuse and mislead consumers." Lawyers representing Fashion Nova deny the allegations, saying there's no infringement since Playboy abandoned its bunny trademark, closed its clubs and stopped printing its magazine. The judge granted a stipulation of permanent dismissal last Friday. The plaintiffs and defendant were also ordered to bear their own attorney fees and costs.
