Facial recognition software is to blame for the wrongful arrest of a Texas man, and now he's suing Macy's and the parent company of Sunglass Hut. Harvey Murphy Jr spent almost two weeks in jail after facial recognition technology falsely identified him as a suspect of armed robbery. When prosecutors verified that Murphy had been in Sacramento, California, at the time of the robbery, he was released. While in jail, Murphy says he was attacked and raped by three men. He is suing the companies for ten million dollars for what he says was a wrongful arrest based on the negligent use of facial recognition software. The lawsuit claims that Sunglass Hut's parent company, EssilorLuxottica, relied on Macy's facial recognition technology to falsely identify Murphy in low-quality surveillance footage of the robbery. Murphy's lawyer says this case highlights the dangers of the technology's use by law enforcement.
